1. General provisions.
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the Rules) are a legal document binding on the Parties, which establishes the rights, obligations and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the e-store.
1.2. The Seller reserves the right to change, amend or supplement the rules at any time, taking into account the requirements established by legal acts. The Buyer is informed on the e-store website. When the Buyer makes purchases in the e-store, the Rules in force at the time of placing the order apply.
1.3. You have the right to buy in the e-store:
1.3.1. capable natural persons, t.y., persons who have reached the age of majority, whose legal capacity is not restricted by court order;
1.3.2. minors between the ages of 14 and 18, only with the consent of their parents or guardians, except in cases where they independently dispose of their income;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above-mentioned persons.
1.4. By approving the rules, the Seller also guarantees that, based on the rules, 1.3. point, the Buyer has the right to purchase goods in the e-store.
1.5. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart in the e-store, specified a delivery address, selected a payment method and familiarized himself with the Seller's rules, clicks the "Confirm order" button (see point 5 "Ordering goods, prices, payment procedure, terms").
2. Protection of personal data.
2.1. To order goods in the e-store, the Buyer can:
2.1.1. by registering in this e-store – by entering the data requested during registration;
2.1.2. without registering in this e-store.
2.2. Buyer ordering goods 2.1. in the manner provided for in the rules, in the relevant information fields provided by the Seller, the Buyer's personal data necessary for the proper execution of the order for goods must be indicated: name, surname, delivery address, telephone number and e-mail address.
2.3. By accepting these rules, the Buyer agrees that 2.2. The Buyer's personal data provided in clause 1 would be processed for the purposes of selling goods and services in the e-store, analyzing the Seller's activities and direct marketing.
2.4. By agreeing to the processing of the Buyer's personal data for the purpose of selling goods and services in the Seller's e-store, the Buyer also agrees to the sending of information messages necessary for the fulfillment of the order of goods to the e-mail address and telephone number specified by the Buyer.
2.5. By registering in the e-store and ordering goods, the buyer undertakes to keep his login details safe and not to disclose them to anyone.
3. Buyer's rights and obligations.
3.1. The Buyer has the right to purchase goods in the e-store in accordance with the procedure established in these Rules and other information sections of this e-store.
3.2. The Buyer has the right to withdraw from the contract for the purchase and sale of goods with the e-store by notifying the Seller in writing (by e-mail, indicating the desired return of the goods and their order number) no later than 14 (fourteen) business days from the date of delivery of the item, except in cases where the contract cannot be withdrawn in accordance with Article 6.228 (10) (2) of the Civil Code.
3.3. Rules 3.2. The Buyer may exercise the right provided for in paragraph 1 only if the goods have not been damaged or their appearance has not substantially changed, and they have not been used.
3.4. The buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.5. If the data provided in the Buyer's registration form changes, the Buyer must update it immediately.
3.6. The Buyer undertakes not to transfer his login details to third parties. If the Buyer loses his login details, he must immediately inform the Seller about this using the means of communication specified in the "Contacts" section.
3.7. By using the e-store, the Buyer agrees to these Terms of Sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
4. Seller's rights and obligations.
4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the e-store.
4.2. If the Buyer attempts to undermine the stability and security of the Seller's e-store or violates its obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer's access to the e-store or, in exceptional cases, cancel the Buyer's registration.
4.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information specified in the e-store registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering goods, prices, payment procedure, terms.
5.1. In the e-store, the Buyer can shop 24 hours a day, 7 days a week.
5.2. The Agreement enters into force from the moment the Buyer clicks the "Confirm order" button, and upon receiving the order, the Seller confirms it by sending a confirmation email to the e-mail address specified by the Buyer.
5.3. The prices of goods in the e-store and in the formed order are indicated in euros, including VAT.
5.4. The buyer pays for the goods in one of the following ways:
5.4.1. Payment via e-banking is a prepayment using the e-banking system used by the Buyer. In order to use this form of payment, the Buyer must have signed an e-banking agreement with one of the banks served. The Buyer transfers the money to the e-store's current account. In this case, the responsibility for data security lies with the relevant bank, since all monetary transactions take place in the bank's e-banking system.
5.4.2. Payment by bank transfer is an advance payment when the Buyer, after printing the order and going to the nearest bank branch, transfers the money to the e-store's bank account.
5.4.3. Payments can be made using Swedbank, Seb, Luminor, Citadele and Šiaulių bankas electronic banking services. Payments are available in euros. Payments are processed using the MakeCommerce.lt payment platform.
5.5. The buyer undertakes to pay for the goods immediately. Only upon receipt of payment for the goods will the goods parcel be formed and the delivery time for the goods begin to be calculated.
6. Delivery of goods.
6.1. The buyer, who has selected the delivery service during the order, undertakes to specify the exact delivery location of the goods.
6.2. The Buyer undertakes to accept the goods themselves. In the event that the Buyer cannot accept the goods themselves, and the goods are delivered to the specified address, the Buyer has no right to make claims against the Seller for the delivery of the goods to an inappropriate entity.
6.3. The Goods are delivered by the Seller or the Seller's authorized representative (courier).
6.4. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the necessary goods in stock, and the Buyer is informed about the shortage of the ordered goods. At the same time, the Buyer agrees that in exceptional cases, the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of delivery of the goods.
6.5. In all cases, the Seller is exempt from liability for violation of the delivery deadlines if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Seller's control.
6.6. The Buyer must in all cases immediately inform the Seller if the shipment is delivered in a crumpled or otherwise damaged package, if the shipment contains unordered goods or an incorrect quantity, or if the goods are incomplete.
6.7. In all cases, the Buyer, having noticed damage to the packaging during delivery, must indicate the remarks in the delivery document provided by the courier or draw up a separate act regarding these damages. The Buyer must do this in the presence of the courier. Failure to perform such actions releases the Seller from liability to the Buyer for damage to the goods related to damage to the packaging that the Buyer did not mark on the courier's delivery document.
7. Product quality, guarantees.
7.1. The data of each product sold in the e-store is generally indicated in the product description for each product.
7.2. The Seller is not responsible for the fact that the color, shape, or other parameters of the goods in the e-store may not correspond to the actual size, shape, and color of the goods due to the characteristics of the display used by the Buyer.
7.3. The Seller provides a quality guarantee for certain types of goods for a certain period of time, the specific term and other conditions of which are specified in the descriptions of such goods.
7.4. If the seller does not provide a quality guarantee for certain types of goods, the guarantee provided for in the relevant legal acts shall apply.
8. Return and exchange of goods.
8.1. The Buyer (natural person) has the right to withdraw from the contract concluded online (return the good) within 14 days without giving a reason (Article 6.228 (10) of the Civil Code), except for the exceptions provided for in paragraph 2 of this Article. The money paid, including the delivery costs paid by the Buyer, shall be returned within 14 days from the date of the Buyer's notification of withdrawal from the contract, however, the Seller may not return the money until the Buyer receives the goods or provides proof that the goods have been sent. The costs of returning the goods shall be borne by the Buyer. In all cases, the money for the returned goods shall be transferred only to the payer's bank account.
8.2. To return the product(s) in accordance with the Terms and Conditions 8.1. point, the Buyer may do so within 14 (fourteen) business days from the date of delivery of the goods to the Buyer, by informing the Seller via the means of communication specified in the contact section, indicating the name of the returned goods, order number and bank account number.
8.3. When returning goods to the buyer, the following conditions must be met:
8.3.1. the returned item must be in its original, neat packaging;
8.3.2. the item must be undamaged by the Buyer;
8.3.3. the product must be unused and in good condition (labels not damaged, protective film not torn, etc.) (this point does not apply in the case of returning a poor-quality product);
8.3.4. the returned item must be in the same condition as the Buyer received it;
8.3.5. When returning an item, it is necessary to provide a proof of purchase.
8.4. The Seller has the right not to accept the Buyer's returned goods if the Buyer does not comply with the 8.3. The article sets out the procedure for returning goods.
8.5. When returning the wrong product and/or a product of poor quality, the Seller undertakes to take back such products and replace them with similar suitable products.
8.6. In the event that the Seller does not have suitable goods for replacement, the Buyer will be refunded the amount paid, excluding the price for delivery.
9. Buyer and seller liability.
9.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not liable for the consequences arising therefrom and acquires the right to claim compensation for direct losses incurred by the Buyer.
9.2. The buyer is responsible for the actions taken while using this e-store.
9.3. The registered Buyer is responsible for the transfer of his/her login data to third parties. If the services provided by the e-store are used by a third party who has logged in to the e-store using the Buyer's login data, the Seller considers this person to be the Buyer.
9.4. The Seller is exempted from any liability in cases where losses arise due to the Buyer not having read these Rules, despite having been given such an opportunity, despite disregarding the Seller's recommendations and the Buyer's obligations.
9.5. If the Seller's e-store contains links to the e-websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained there or the activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
9.6. In the event of damage, the at-fault Party shall compensate the other Party for direct losses.
10. Marketing and information.
10.1. The seller may, at his/her discretion, initiate various promotions in the e-store.
10.2. The Seller has the right to unilaterally, without separate notice, change the terms and conditions of the promotion, as well as cancel them. Any change or cancellation of the terms and conditions of the promotion and procedure is valid only in the future, t.y. from the moment of their execution.
10.3. The Seller sends all notifications via the means of communication specified in the Buyer's registration form.
10.4. The Buyer sends all messages and questions to the telephone numbers and email addresses specified in the "Contacts" section of the Seller's e-store.
10.5. The Seller is not liable if the Buyer does not receive sent information or confirmation messages due to disruptions in the Internet connection or email service provider networks.
11. Final provisions.
11.1. These Rules for the purchase and sale of goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
11.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.3. Consumer disputes are resolved out of court by the State Consumer Rights Protection Service, registered office address: Vilniaus St. 25, LT-01402 Vilnius, www.vvtat.lt.
11.4. The buyer can submit requests or complaints regarding possible violations of consumer rights on the electronic consumer dispute resolution platform. http://ec.europa.eu/odr/.
